Improper Disclosure of Confidential Pricing in Bid Process

When a US-based public company received allegations that a senior executive shared confidential pricing and proprietary information submitted by competitors in a competitive bidding process to another company submitting a bid, Axium was retained to respond to the challenge. Axium conducted a forensic review and analysis of the executive’s computer and conducted an extensive email review. We documented the existence of close personal relationships between the executive and representatives of several vendors. We identified several specific instances, including through coded language, in which the executive provided confidential pricing and other information of competitors to vendors that directly impacted the competitiveness of the bidding processes. Axum conducted interviews of numerous employees involved in the tainted bidding processes. We interviewed the suspect employee, and, based on our findings, her employment was terminated.
